Ten Sixty Four Limited (Administrators Appointed)

Martin Ford and Simon Theobald were appointed Joint and Several Voluntary Administrators of the Company on 2 July 2023 pursuant to Section 436A(1) of the Corporations Act 2001 (Cth) (the Act).

Initial Report to Creditors dated 4 July 2023

The Administrators prepared a report to creditors notifying of their appointment and to provide information about the voluntary administration of the Company and their rights as a creditor. This report also provides details of the first meeting to creditors that will be held on Wednesday, 12 July 2023 at 10:00am (AWST).

Major Report to Creditors dated 23 October 2023

The Administrators prepared a report to creditors outlining our investigations into the Company and the Company’s business, property, affairs and financial circumstances. We also report on the following three options available to creditors (including employees):

  • end the voluntary administration and return the company to the directors’ control;
  • approve a DOCA through which the company will pay all or part of its debts and then be free of those debts
  • wind up the company and appoint a liquidator.
Ten Sixty Four Limited (Subject to Deed of Company Arrangement)

At the adjourned second meeting of the Company’s creditors held on 31 October 2023, creditors of the Company resolved that the Company execute a Deed of Company Arrangement (DOCA ) DOCA. The DOCA was executed on 1 November 2023, and lodged with the Australian Securities and Investments Commission shortly thereafter.

Update Report to Creditors

An updated report was circulated to creditors to provide an update on the status of the Deed of Company Arrangement, including progress on the conditions precedent and the Restructuring Framework Agreement executed in March 2024.
